My research agenda—as well as my professional interests—focus on alternative dispute resolution. I have been a strong proponent of the advantages of negotiation, mediation and arbitration vis-à-vis litigation. The principal aim of my research is to influence the development of this area of the law by presenting my views on the appropriate use of ADR and arguments for changes in the law.
In particular, I am interested in the law of alternative dispute resolution as it relates to the provision of medical services and nursing home care, a topic of much litigation and legislation, has been one of the subjects of my research. As the population of the United States ages, the development of the law as it affects the elderly and their healthcare at the end stages of life becomes increasingly important. I am particularly interested in the role arbitration and mediation should play in disputes between health care providers and their patients.
My articles have appeared in law school law reviews, state bar journals and other academic publications. They have been cited in three Petitions for Writ of Certiorari filed in the United States Supreme Court, an amicus brief filed in the Supreme Court of Missouri, books, articles, and the statutory annotations of several states.
